Driving With Suspended Registration

Driving with Suspended Registration this occurs when a car owner has a lapse in insurance. The insurance company notifies motor vehicle that the individual did not have insurance. Motor Vehicle then suspends the persons registration oftentimes without giving the person notice. When an individual gets pulled over with a suspended registration charge it is a misdemeanor. The police know that an individual has a suspended registration due to scanning the plates of the motorists car as they pass. Oftentimes this person also received a ticket for having no insurance.

Driving With No Insurance / Suspended Registration Tickets

Driving with a suspended license can occur in a number of ways occurs by the when a person does not answer a summons that they may have received or if the person has a lapse in insurance. If the person does not appear in court, the court will notify motor vehicle and the person’s license will be suspended, that is one way that a person’s license is suspended. Often times many clients do not know that their license is suspended due to a change in address, and they are not notified. Another reason that a person’s license would be suspended is due to having no insurance. Clients often come to me for representation in the situation when they do not pay their insurance and what happens is motor vehicle is notified by the insurance company and as a result motor vehicle suspends the person’s registration.

Suspended Registration in Suffolk County

In Suffolk County, if the car is not registered to you and you are caught driving, the district attorney’s position will be to dismiss the charges, however, if you are the owner often times the case will have to be conferenced with a supervisor. The district attorney is very strict on these charges and the policy is that either you plead to a misdemeanor driving with no registration or the charge of no insurance. The problem then becomes if you plead to driving with no insurance, motor vehicle is notified that you were driving with no insurance and motor vehicle will take action against the person’s license after they take a plea. Motor vehicle can suspend the individual’s license for one year and impose a civil penalty of between $500 and $1000.

When an individual retains my services I am often able to negotiate these tickets down to a violation where the client will not plead to any charges that result in both of the suspension and the civil penalty. I often speak with a supervisor. If you have an insurance lapse, your registration will be suspended, as well as your license. Police scan individuals license plates and are able to tell if the persons registration is suspended from these scans. This is important to know. Oftentimes there are insurance lapse for people not getting their bills in the mail if they use an insurance broker or there is a change in banking information if the person pays their insurance through their debit account or some other direct method.

There are 5 types of tickets that you can receive for driving with a suspended license. They range from a violation to a misdemeanor to a felony charge.
